Face to Face: A Rebuttal On AB 284 (Video)

reno nv ab 284So my quote in the Reuters article, here, regarding AB 284 has moved to the big screen. Well, not really the big screen unless you own a very large flat screen.

Face to Face , typically hosted by John Ralston,  took on the good and the bad side of AB 284 in a recent taping and included the Reuters’ article as a talking point.

The first segment in the video below includes broker Glenn Plantone, of VIP Realty in Vegas, discussing the foreclosure statistics down south that compare to the Reno/Sparks area less magnitude due to population differences. Most of the information he provides is an echo of what we hear up north like appraisal issues and multiple offers but nonetheless worth listening too.

The meat and potatoes of the show begins at the 11:45 mark. Victor Joecks of NPRI and Andras Babero of Black and LoBello go back and forth on the positive and negative effects of the bill.

Much of the quotes are paraphrased for space and because I didn’t want to take the time go word by word. The audio is marked if you want to do the research.

10:30 mark: “I have a challenge to the premise that this is a bad law and does these things (referring to lack of inventory and poor housing market in the previous segment)… 284 didn’t do all those things.…”.

I completely disagree with this and have covered it in another post. In September of 2011 there were 1700 active and available homes in Reno/Sparks. By May 2012 there were 778. Something had to have created this shortage. Enter Ab 284 in October of 2011.

Below is a historical chart for the Notice of Default filings in Nevada. A NOD is when a bank publicly informs the home owner that they have missed their payments and the foreclosure process has started. At this point most home owners seek legal counsel and potentially list their property as a short sale…

…Meaning, another home is added to inventory. When there isn’t any fear of losing the home or at least in a typical foreclosure time frame the home doesn’t go on the market. Home owners want to ride it out and see how long they can live for free.

I won’t even get into how this affected Notice of Sales (NOS) that were ready to be foreclosed but the correct answer is… Yes, the bill did affect the housing market.

7:45 mark: In reference to people using Ab 284 to live free and the affect on neighborhoods. “What you have by far and away are people that are trying to do the right thing… short sale, modification… those are the predominate ones. The ones were there sitting in there for year after year after year are much smaller.

I’d like to invite Mr. Babero to hang out with a Realtor at BBQ’s, dinners, and through our daily lives to hear the kind of questions we get on how long someone can stay in a home without getting the boot.

I understand and know many people that are really trying to work with the bank but to say they’re the predominate ones is a big stretch. These websites might open his eyes.     http://www.strategicdefault.org/     http://www.strategicdefault.com

According to NV Assemblyman Marcus Conklin (Main Sponsor), “…this bill is not about recovery. This is about justice, plain and simple.“  (Senate Commitee on Judiciary Page 20)

I partly disagree. The law is not justice but the courts do serve justice. Simply putting a law together doesn’t mean that everyone’s actions will be just. The banks broke the law in the robo-signing debacle and paid the price… National Mortgage Settlement. If they do it again then go after them a second time, a third time, etc. Why continue to delay the inevitable with this bill?

My point of this post wasn’t to blast Mr. Babero or Assemblyman Conklin but to show how near sighted the bill is. The policy was done on the micro level without taking into account what would happen to those that are still making their payments. The law was there. All you needed to do was uphold it. Throwing another wrench into the works isn’t going to help.

This is a pretty controversial issue so by all means express your opinion in the comments.

On a side note, from the same Senate Commitee on Judiciary minutes… Assemblyman Conklin, “To suggest that the market will recover much slower is false.”

Oops.

Know Your City: 2011 Great Reno Balloon Race

It’s time again to set your alarms to 4:00 am for the 2011 Great Reno Balloon Race. The race which celebrates it’s 30th anniversary this year starts on Friday the 9th and ends Sunday the 11th. While most of the action is in the early morning this is still a great family event for kids of all ages. Fun shaped balloons for this year include Smokey the Bear, a soccer ball, a panda bear, and the Wells Fargo stagecoach among other colorful balloons. To make it even better entry to the event is FREE!

Below is a schedule and some tips on how to make the most out of your early morning.

Saturday – Sunday Schedule

5:00 am: Glow Show-Glowing balloons light up the pre-dawn darkness as guests enter the field.

5:30 am: Dawn Patrol-A few select balloons are allowed to take flight, in darkness, and  light up the sky with a choreographed light show accompanied by music.

6:45 am: Mass Ascension- All balloons lift off  and begin their race around the city.

Rest of the day: The fun doesn’t stop when all the balloons are airborne.  Make this your day out on the town and you might just walk out of a restaurant or shopping center to find a lost balloon waiting in the parking lot.

Tips

Prepare for the conditions: It may be summer but the Nevada high desert can be cold before dawn. Be sure to pack an extra layer of clothes or blankets to stay warm.

Make your experience comfortable: Unfortunately, seating is not provided at the field. Come prepared with blankets or chairs so you don’t have to stand for the event.

Bring your camera: The race offers an array of photo opportunities from mid air balloons to grounded balloons available for up close shots.

Get there early: Maybe the most important tip of all. The event is widely popular in the Truckee Meadows and parking is always an issue on the north end of the University of Nevada. Be sure to get there early and prepare to walk up to a mile in order to get into the event. Show up late and you might be standing for the event.

Know Your City: Somersett Farmer’s Market

Located in Northwest Reno, the Somersett community not only offers championship golf with country club living but also hosts a local farmer’s market every Wednesday. The market, which runs in the summer months from 4:00 pm to around 7:00 pm, is geared for all ages and includes a live band to listen to while shopping or sitting back and enjoying your favorite drink.  Numerous vendors and local farms line the town square with offerings of local and/or organic fruits and vegetables, freshly baked bread and oils, and clothing among others. Paint the Town Blue

As the biggest game in program history looms with BCS #4 Boise State, the community is rallying behind their Wolf Pack*. Of the many events planned for the week, the changing of the “Biggest Little City” sign may be the most visible. The City of Reno purchased new “Nevada” blue lightbulbs that were installed for a ceremony on November 22nd. The city has also asked the downtown casinos to put up their blue lights, similar to the lights used for the NCAA tournament Sweet Sixteen run in 2004.

Game time is set for 7:15 pm on Friday at Mackay Stadium. The game is sold out from the ticket office but there are some seats available through StubHub between $120 and $150 per ticket. If you can’t find a ticket, the game will be broadcast on ESPN. Below is a list of scheduled events to support the Pack before the game.

  • November 26th Downtown Tailgate: Time and exact location to be determined
  • November 26th University of Nevada Alumni Tailgate: 5:00 pm at Legacy Hall $10 for alumni $15 for non alumni. Includes all you can eat buffet.

Highest Card Wins

In classic Nevada form, the Clerk/Treasurer seat of rural Eureka County, will be decided by a draw of cards. The incumbent Jackie Berg had a six chip lead after the count on November 2nd. Challenger, Carrie Wright, went all in by asking for a recount. The result… three chips were awarded to the challenger creating a tie and a Nevada election card draw for whole pot.  Think I’m kidding? Read the law for yourself, NRS 293.400:

“1.  If, after the completion of the canvass of the returns of any election, two or more persons receive an equal number of votes, which is sufficient for the election of one or more but fewer than all of them to the office, the person or persons elected must be determined as follows:….

(c) For any office of a county, township, incorporated city, city organized under a special charter where the charter is silent as to determination of a tie vote, or district which is wholly located within one county, the county clerk shall summon the candidates who have received the tie votes to appear before the county clerk at a time and place designated by the county clerk and determine the tie by lot. If the tie vote is for the office of county clerk, the board of county commissioners shall perform these duties.”

The best part is that the law is being used to its fullest extent. Not only is there a tie for office but it is with the county clerk who is supposed to holding the draw. Per law, the county commissioners will now be in charge of the deck. The final hand will dealt on Friday the 19th and I will be rooting for double aces.

As crazy as this is, we native Nevadans wouldn’t have it any other way.

$8000 Home Buyer Tax Credit extended and expanded for 2010

The Worker, Home Ownership, and Business Assistance Act of 2009 has extended and expanded the home buyer tax credit through 2010.

 First Time Home Buyer Tax Credit of $8000

  • The credit has been extended to cover sales from January 1, 2010 through April 30, 2010.
  • A binding executed contract prior to April 30, 2010 will qualify for the credit as long as it closes by June 30, 2009.
  • Income limits for single taxpayers is $125,000 until January 1, 2010 and $75,000 from January 1, 2010 to April 30 , 2010.
  • Income limits for married taxpayer filing jointly is $225,000 until January 1, 2010 and $150,000 from January 1, 2010 until April 30, 2010.
  • The property must be a primary residence and the buyer must not have owned a property within the past three years.

Move Up Home Buyer Tax Credit of $6500

  • Property must be purchased as a principal residence. No investment properties.
  • The credit has been extended to cover sales from January 1, 2010 through April 30, 2010.
  • A binding executed contract prior to April 30, 2010 will qualify for the credit as long as it closes by June 30, 2009.
  • Married filing separately can only claim $3250.
